1. Introduction and Acceptance

Welcome to Tutor In My Pocket. These Terms and Conditions ("Terms"), together with our Privacy Notice, govern your access to and use of the Tutor In My Pocket platform, including the website at tutorinmypocket.co.za, the AI-powered learning companion ("Lumi"), the parent dashboard, and all related features and services (collectively, the "Platform").

By registering for an account, clicking "I Agree," or otherwise accessing or using the Platform, you confirm that:

  • You are at least 18 years of age;
  • You have read, understood, and agree to be bound by these Terms in their entirety;
  • Where you are subscribing on behalf of a child or learner, you are the parent or legal guardian of that child and have the authority to consent on their behalf;
  • You consent to the processing of your personal information as described in this document and in our Privacy Notice.

If you do not agree to these Terms, you must not access or use the Platform.

2. About the Platform

Tutor In My Pocket is a South African AI-powered educational platform designed for learners in Grades 4 to 7. The Platform uses a Socratic method of guided questioning to help learners work through schoolwork and homework independently, without providing direct answers. The AI tutor character, Lumi, guides learners through concepts by asking questions rather than supplying solutions.

The Platform is intended to supplement, not replace, formal schooling. Content is aligned with the Curriculum and Assessment Policy Statement (CAPS) as published by the South African Department of Basic Education. Tutor In My Pocket is not affiliated with, endorsed by, or officially accredited by the Department of Basic Education or any provincial education department.

3. Accounts and Registration

3.1 Parent Account

Access to the Platform is granted exclusively through a parent or legal guardian account. To register, you must provide your full legal name, a valid email address, a valid South African mobile number, and payment details for subscription billing. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@tutorinmypocket.co.za if you suspect any unauthorised access.

3.2 Learner Profiles (Child Usernames)

A core design principle of Tutor In My Pocket is the protection of children's personal information. We deliberately do not collect, store, or process any personally identifiable information about learners. Instead:

  • Each learner is represented by a self-chosen username only (for example: "Arsenal," "StarGirl," "IronMan");
  • The learner selects a grade level (Grade 4, 5, 6, or 7);
  • The learner may select an animal companion avatar;
  • No real name, date of birth, school name, photograph, or any other identifying information about the learner is collected, requested, or stored.

All parent-facing reports and dashboard content reference learners exclusively by their chosen username. For example: "Arsenal completed a 22-minute session on fractions this week."

4. Subscription, Billing, and Cancellation

4.1 Subscription Tiers

The Platform operates on a monthly subscription basis:

  • 1 Child — R189.00 per month (1 learner profile);
  • 2 Children — R279.00 per month (2 learner profiles);
  • 3–5 Children — R359.00 per month (3 to 5 learner profiles).

All prices are in South African Rand and inclusive of VAT at the applicable rate. We reserve the right to adjust pricing with a minimum of 30 days written notice.

4.2 Billing

Subscription fees are billed monthly in advance via PayFast. By subscribing, you authorise Tutor In My Pocket to charge your chosen payment method on a recurring monthly basis until cancellation. Failed payments may result in temporary suspension of access.

4.3 Free Trial

Where a free trial is offered, no charge applies during the trial. At the end of the trial, your subscription automatically converts to the applicable paid tier unless you cancel before the trial expires. We will remind you by email before your trial ends.

4.4 Cancellation

You may cancel at any time by logging into your account and selecting "Cancel Subscription," or by emailing hello@tutorinmypocket.co.za. Cancellation takes effect at the end of the current billing cycle. We do not offer refunds for partial months. Access continues until the end of the period already paid for.

4.5 Consumer Protection Act

In terms of Section 14 of the Consumer Protection Act 68 of 2008, you have the right to cancel a fixed-term agreement with 20 business days notice. As our subscriptions are month-to-month, you may cancel at any time as described above.

5. Acceptable Use

By using the Platform, you agree that you will not:

  • Attempt to reverse-engineer, copy, reproduce, or distribute any part of the Platform or its underlying AI model or system prompts;
  • Use the Platform to generate content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable;
  • Attempt to circumvent, disable, or interfere with any security features;
  • Share your account credentials with any person other than the learners registered under your account;
  • Use automated tools, bots, or scripts to access the Platform.

We reserve the right to suspend or terminate accounts that breach these provisions without prior notice and without refund.

6. Intellectual Property

All content on the Platform, including the Lumi character, the Tutor In My Pocket brand, system prompts, user interface design, session report formats, and written content, is the exclusive intellectual property of Tutor In My Pocket (Pty) Ltd and is protected by South African copyright law. The CAPS curriculum framework referenced is the property of the Department of Basic Education; our use of CAPS topic structures is solely for curriculum alignment and does not imply any official endorsement or affiliation. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial educational purposes only.

7. Disclaimer of Warranties and Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. While we take reasonable steps to ensure accuracy, AI-generated educational guidance may not always be accurate, complete, or appropriate for every learner or situation, and is not a substitute for qualified professional educational assessment. To the maximum extent permitted by South African law, Tutor In My Pocket (Pty) Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability in any calendar month shall not exceed the subscription fee paid by you in that month. Nothing in these Terms excludes liability that cannot be excluded under South African law.

8. Changes to These Terms

We may update these Terms at any time. Where changes are material, we will notify you by email at least 14 days before they take effect. Continued use after that date constitutes acceptance. If you do not agree, you must cancel before the effective date.

9. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any dispute shall first be referred to informal mediation; if mediation fails, to a court of competent jurisdiction in South Africa.
